The Law of Extra-contractual Civil Liability or Law of Damages, not only constitutes a very important part of the Law of Obligations, but also profoundly affects the daily life of citizens and the competitiveness of companies, especially in the insurance sector. 

It is enough to remember the very high number of traffic accidents, the recent episodes of maritime shipwrecks or aircraft accidents; or the frequency with which damage is caused in the development of activities such as construction, mass distribution of products intended for human consumption, or interference in the honor or privacy of people with greater or lesser public relevance, through the information media. 

In recent decades, non-contractual liability has acquired capital importance both in Spain and in neighboring countries. Specifically, a quarter of the cases decided by the First Chamber of the TS have as their object litigation in matters of Extra-contractual Civil Liability. On the other hand, the civil liability action has a marked transversal character. It is exercised, not only in civil jurisdiction, but in the five jurisdictional orders: criminal, contentious-administrative, social and military. 

Law for a new era 

There is no doubt that we are in a new era. The use of new technologies is here to stay and is changing our way of life and relationships among human beings. The benefits, but also the harm, of the massive use of computers, mobile phones, search engines, home automation systems, robots and artificial intelligence agents are already being felt intensely. 

Technological advances must be at the service of citizens and their use must not have the effect of diminishing or replacing their capacity for initiative or creativity, much less be an instrument of violation of fundamental rights such as freedom, dignity, or Privacy. 

The Social Sciences must be able to anticipate when identifying the implications and providing solutions to the conflicts that artificial intelligence and the digital revolution will bring with them in social relations. 

Specifically, in the field of civil liability, the fundamental challenge is to develop the imputation criteria and determine the subject in charge of the damages caused by the use of robotics and digital technologies.
