Enrollment dates: From September 9 to 11, 2024, students who have been admitted by partial validation of foreign studies may register at the student secretary of the corresponding faculty.
STATEMENT OF MOTIVES
In compliance with current regulations, and given the growing mobility of students, already existing before but which has undergone a significant increase after the implementation of the European Higher Education Area, it is necessary to update the regulations for one type of access at a time. with more requests, such as access by Partial Validation of Foreign Studies.
Due to the progressive implementation of Bachelor's degrees at the Rey Juan Carlos University, the Partial Validation of Foreign Studies will only be effective for those degrees, for those courses and for those subjects that are implemented in that academic year of the admission resolution.
Taking into account the current legislation, it is necessary, from the Rey Juan Carlos University, to carry out the following Guidelines for the Partial Validation of Foreign Studies.
APPLICABLE LEGISLATION
For the development of these Guidelines, the following regulations must be taken into account:
- Royal Decree 889/2022, of October 18, which establishes the conditions and procedures for homologation, declaration of equivalence and validation of university education from foreign educational systems and which regulates the procedure to establish correspondence to the level of the Spanish Qualifications Framework for Higher Education of the official university degrees belonging to previous academic ordinances.
- Agreement of October 25, 2004, of the University Coordination Council, which establishes the general criteria to which universities must comply in terms of validation and adaptation of studies completed in Spanish or foreign academic centers.
- Royal Decree 822/2021, of September 28, which establishes the organization of university education and the procedure for ensuring its quality.
- Royal Decree 412/2014, of June 6, which establishes the basic regulations for admission procedures to official university degree courses.
- Regulations of the Rey Juan Carlos University for the validation, recognition and transfer of credits in university degrees.
Art.1- SCOPE OF APPLICATION
These guidelines will apply to applications for admission requested through Partial Validation of Foreign Studies by students with partial or full foreign university studies who have not obtained the homologation of their degree in Spain.
Art. 2- REQUIREMENTS
2.1.- Students will be able to request Partial Validation of Foreign Studies provided that one of the following circumstances occurs:
- When the foreign higher education studies carried out meet the criteria set by the Council of Universities and have not concluded with obtaining the corresponding title.
- When the foreign higher education studies carried out meet the criteria set by the Council of Universities, have concluded with the obtaining of a foreign degree, and the interested party has not applied for its homologation by an official Spanish university degree.
- When the homologation of the foreign degree has been requested, it has been denied, provided that the denial has not been based on any of the causes included in article 4.2.b). c) and d) of Royal Decree 889/2022, of 18 October 2022 (BOE of October 19), which establishes the requirements and procedure for the homologation and declaration of equivalence to a degree and official university academic level and for the validation of foreign higher education studies.
2.2.- Students may request Partial Validation of Foreign Studies at the Rey Juan Carlos University for Undergraduate Degrees, knowing that, due to their progressive implementation, not all courses or all subjects of the plan can be activated until the full implementation of the degree.
2.3.- Only the subjects passed by the student can be recognized/validated provided that the content and the study load are equivalent to the corresponding subjects included in a study plan leading to obtaining an official title to which they intend to access.
2.4.- Applications for places for students with foreign university studies, partial or complete, will be resolved by the Rector of the University in accordance with the following rules:
- The admission of students who have validated a minimum of 30 credits will be made in accordance with the places available. The places to be covered by this system will be up to a maximum of 1% of the general offer of places in the previous course in the qualifications indicated by the Vice-rectorate for Students. The award order for all those students who meet the established requirements will be as follows:
- Greater number of recognized credits.
- Average grade of the academic record.
- Students who do not obtain admission by partial validation must pass the entrance exam to Spanish universities, unless the pre-university studies that have been approved or validated give direct access to the university without the need to pass entrance exams, without prejudice to the temporary priorities and assessment criteria established in Royal Decree 412/2014, of June 6, which establishes the basic regulations for admission procedures to official university degree courses.
2.5.- For the homologation of pre-university and high school studies, students must contact the Ministry of Education.
Art. 3- PROCEDURE
3.1.- Interested parties will request admission for Partial Validation of Foreign Studies, within the established period, through the computer platform for admission application for Partial Validation of Foreign Studies, in accordance with the provisions of these guidelines.
3.2.- The documentation submitted by the interested party in their request for access to a degree by Partial Validation of Foreign Studies is reviewed by the Office of the Vice-Rector for Students, and when it is complete, from the area of the corresponding Faculty or School to which they belong the requested degree will propose which subjects, of those included in your application, are subject to validation and which are not.
In case of lack of documentation, the same will be requested from the interested party, having a period of 15 days to correct the errors and lack of documentation appreciated. If the requested documentation is not submitted within the established period, the request for access to the degree by Partial Validation of Foreign Studies will be understood as withdrawn by the interested party.
3.3.- The corresponding Faculty or School will propose the possible validation of subjects before June 15.
3.4.- In the case of being admitted to the degree requested, the student will have to go, on the dates established for this, to the Student Secretary of the Faculty or School in which the degree in which they have been admitted is taught. To formalize the registration, providing at that moment original and photocopy of the following documents:
- DNI, Passport or Residence Card in force.
- Certificate accrediting the level and class of studies that is intended to be validated and stating the subjects studied and passed (Academic Certificate) legalized through diplomatic channels or with the Hague apostille.
Once the student has enrolled, they must pay the fees that the Governing Council establishes for the 2024-25 academic year for the validation of studies carried out in foreign centers and the validation of subjects. of the Community of Madrid, by means of the corresponding Decree by which the public prices for university studies leading to official titles and services of an academic nature are set at the public universities of the Community of Madrid.
3.5.- In the event of not meeting any of the legally established requirements, or not having validated/recognised the minimum number of credits set by current regulations or not having been awarded a place in the degree requested, the student will receive a resolution negative.
In this case, you can exercise your right to claim according to what is established in the resolution received, before the Office of the Vice President for Students.
Art. 4- DEADLINES
4.1.- The deadline for submitting admission applications for Partial Validation of Foreign Studies will be established by the Rey Juan Carlos University for each academic year, and published through the university's website once it has been approved.
4.2.- The Application for admission by Partial Validation of Foreign Studies will be prior to enrollment, since the favorable resolution of the same is what gives access to the requested studies.
4.3.- The favorable resolution of the application for admission by Partial Validation of Foreign Studies will be without effect if the interested party does not formalize the enrollment in the academic year in which it was granted, or in the following academic year immediately after.
Art.5- DOCUMENTATION TO SUBMIT
5.1.- All the documents that are presented must be official, issued by a competent authority and legalized through diplomatic channels, in the Embassies or Consulates of Spain existing in each country from which the documents come, and with the approval of the Ministry of Foreign Affairs. Foreign Affairs of Spain (the approval of the Ministry of Foreign Affairs of Spain will not be required in the duly legalized documents that have the transparent security label on the last legalization signature incorporated). It will be accompanied, where appropriate, by its translation into Spanish carried out by a Sworn Translator or by a Diplomatic Representative.
Documents that have been issued in countries that have signed the Andrés Bello Agreement (Bolivia, Colombia, Chile, Cuba, Ecuador, Panama, Paraguay, Peru and Venezuela) have been legalized by diplomatic channels dated prior to June 10, 2013.
Legalization is not necessary for documents issued in countries of the European Union and European Economic Area, nor documents that are stamped with the "APOSTILLE" (The Hague Convention).
5.2.- The documentation to be submitted by the interested party, in their telematic application through the computer platform for admission application for Partial Validation of Foreign Studies, is as follows:
- DNI, Passport or Residence Card in force.
- Certificate accrediting the level and class of studies to be validated and stating the subjects studied and passed (Academic Certificate).
- Declaration of Equivalence of the Average Grade of the Academic Record of studies completed abroad, granted by the Spanish Ministry of Universities. This declaration is requested at the web address: https://www.universidades.gob.es/equivalencia-de-notas-medias-de-estudios-universitarios-realizados-en-centros-extranjeros/
- Curriculum or table of subjects, issued or published by the corresponding Center, including the subjects required to achieve the degree of origin that is intended to be validated, stamped by the center of origin.
- Program of each of the subjects to be validated, in which the content and the scope with which they have been studied appear, stamped by the center of origin.
- In the case of partial studies, a sworn statement stating that the studies to be validated have not been completed.
- In case of total studies:
- Refusal of approval by the Ministry of Education, for reasons other than those mentioned in article 4.2.b). c) and d) of Royal Decree 889/2022, of October 18, 2022 (BOE of October 19), in which expressly states the possibility of partially validating
- Sworn declaration that a procedure for homologation of the title in Spain has not been simultaneously initiated.
5.3.- For degrees taught in Spanish, students with nationality from non-Spanish-speaking countries who also come from the educational system of a country whose official language is not Spanish, must accredit a B2 level in Spanish through the corresponding certificate issued by one of authorized entities (said certificate accrediting Spanish language level must be located on the application platform in the section "Equivalence of the Average Grade of the Academic Transcript" in a single file together with the document of Equivalence of the Average Grade of the Academic Transcript) .
For degrees taught in English, it will be necessary to accredit a minimum level of B2 of the Common European Framework of Reference for Languages (CEFR), through the corresponding certificate issued by one of the authorized entities (said certificate accrediting the level of the English language must be located on the platform application in the section "Equivalence of the Average Grade of the Academic Record" in a single file together with the document of Equivalence of the Average Grade of the Academic Record)
Art. 6- RESOLUTION
6.1.- After the proposal phase of subjects subject to validation from the corresponding Faculties or Schools, the Office of the Vice President for Students will determine whether or not each specific application for admission to a degree by partial validation of foreign studies meets the requirements to be awarded one of the places available.
6.2.- The Rector will issue a letter of acceptance or denial of the application for admission to a degree by Partial Validation of Foreign Studies that will be sent to the interested party.
6.3.- Interested parties may make the claims they deem appropriate before the Vice-Rectorate for Students.
TRANSITIONAL PROVISION
Taking into account the progressive implementation of the Degrees at the Rey Juan Carlos University, students who access these studies may only enroll in the subjects that are offered.
ADDITIONAL PROVISIONS
These guidelines, and the administrative acts derived from their application, may be challenged within the terms and in the manner established in Law 39/2015.
